Mark Lefkow joined Nall & Miller in 2000 after graduating from Emory University School of Law. Mr. Lefkow earned his Bachelor of Arts degree in Political Science, with honors, from the University of Michigan in 1995.
Mr. Lefkow has handled a wide array of matters since joining Nall & Miller, including serving as first and second chair in trials in Georgia and Federal courts and submission of briefs to the Georgia and Eleventh Circuit Courts of Appeals. His practice involves complex litigation, including general civil litigation, insurance coverage disputes, post-judgment collection matters, business and corporate governance matters, health care litigation, real estate litigation and defense of warranty rights cases.
Selected results include:
Three grants of full summary judgment in federal warranty rights cases (Bailey v. Monaco Coach Corporation, Monticello v. Winnebago Industries, Inc. and Mize v. Winnebago Industries, Inc., Northern District of Georgia);
Obtaining a dismissal with prejudice as co-lead counsel in a consumer class action seeking over $4 billion in damages (Verdery, et al. v. Staples, Inc., Richmond County Superior Court), which included making arguments before the Federal Communications Commission
Collection of $450,000 on a post-judgment collection matter where the debtor filed for Chapter 7 bankruptcy protection (Tempco Electric Heater Corporation v. Prime Technology Group I, LLC, U.S. Bankruptcy Court, N.D. Ga.);
Defense verdict in a vehicle property damage suit (Hollinger v. Alltow, Walton State Court);
$9.5 million verdict as plaintiffs' co-counsel in civil rights and defamation case tried in federal court (Bennett and Reid v. Hendrix, Northern District of Georgia);
Grant of full summary judgment in a state court warranty rights case (Little v. Coachmen, Cobb County State Court);
Grant of full summary judgment on behalf of a homeowner in two real estate covenants case (Estates of Cascade and Dawkins v. Rogan, Fulton County Superior Court);
Grant of full summary judgment in a medical malpractice case (Gibson v. Jimenez, Gwinnett County State Court);
Gaining relief from stay in three bankruptcy cases (Trammell v. Podany, Cady v. Toccoa Metal Technologies, Northern District of Georgia, Bank of Oklahoma v. Lafayette Lifeplans, Southern District of Georgia);
Successfully foreclosing on real property and collecting $150,000 for a construction company (Mike Graham Construction v. Smith, Cobb County State Court);
Collection of $1.6 million as co-counsel in a plaintiff's personal injury action (Young v. Beers Constr. Co., Fulton County State Court);
Setting aside of a $170,000 default judgment (Perdue v. Real Property Services Corporation, Fulton County Superior Court).
